The reduction concerns fines from this month and also older fines. The information that this reduction would be made automatically was advanced by Jornal de Notícias and confirmed by the Ministry of State and Finance.

"In this case, the general regime for administrative offenses determines that if there is a new law that brings a more favourable regime, this will be applied to all ongoing processes".

The ministry clarifies that, in this context, the "intervention of local services, the aforementioned legal regime, without dependence on requests presented by taxpayers, will not be necessary in all administrative offense processes, whether not yet paid or even if paid, if this payment occurred on a date after the production of effects provided for in article 4 of Law no. 27/2023, that is, on July 1, 2024".

The text resulted from a proposal by the Socialist Party, and differs slightly from the final text approved by the Commission, which determined that it "constitutes a single administrative offence" if the figures carried out by the same agent, in the same month, through the use of the same vehicle and which occur in the same road infrastructure "with the minimum value [of 25 euros] corresponding to the maximum toll fees".

At the time of the 'green light', socialist deputy Hugo Costa told Lusa that the new wording of the law would "give proportionality to the value of the fines" applied in these situations, eliminating the disproportionality that currently exists in relation to the infraction committed and that in several situations resulted in debt proceedings worth several thousand euros.

The limit on administrative offenses for non-payment of tolls determines the new rules, which state that infractions committed by the same car, on the same road, and in the same month will have a maximum value equivalent to a single administrative offense.
